Who are you signing with?

By Burstimo 1 min read

An artist may choose a management company because of one particular manager. It is worth asking what happens to the agreement if that person leaves.

The relationship you expect to have and the contract you sign need to line up.

Understand the key person provision

The Musicians’ Union explains that a key person clause can address this situation: an artist signs with a company on the basis that a named person will manage them. The clause can provide a right to end the agreement if that person leaves.

The wording matters. Do not assume that a change of personnel automatically ends a contract, or that a generic clause will fit your circumstances.

Resolve the details before signing

Ask who will do the day-to-day work, how responsibilities are described and what happens if the team changes. Put those questions alongside the other terms you are discussing.

The Musicians’ Union’s specimen management agreement and notes explain the issue in more detail. Have a qualified music solicitor review your own agreement and any proposed changes before you rely on them.
